Rules of the “Green Cadet by Mouton Cadet at We Love Green” Contest

Article I :

The company Baron Philippe de Rothschild France Distribution, a Simplified Joint Stock Company (Société par actions simplifiée), registered with the Paris Trade and Companies Register under number B572053528 and having its registered office at 14-16 rue Montalivet, 75008 Paris (hereinafter referred to as the “Organizing Company”), is organizing a free contest with no purchase obligation entitled «Mouton Cadet Green Cadet Contest at We Love Green» (hereinafter referred to as the “Contest”) which will take place on the blog Mademoiselle Bon Plan, from Friday, May 19, 2017 at 8:00 PM until Saturday, May 27, 2017 at 11:59 PM (Paris time).

This Contest is governed in its entirety by the provisions defined in these rules to which every participant submits (hereinafter referred to as the “Rules”).

ARTICLE II :

The Contest is open to any natural person over 18 years of age residing in Paris, Metropolitan France (hereinafter referred to as the “Participant” or collectively as the “Participants”).

Participation in the Contest is strictly personal and non-transferable. Only one entry per person and per household (same name, same postal address, same IP address) will be accepted for the duration of the contest. Any additional entries will be considered void.

The following may not participate in the Contest:

  • staff members of the company BARON PHILIPPE DE ROTHSCHILD France DISTRIBUTION, and more generally of the company BARON PHILIPPE DE ROTHSCHILD;

  • staff members of the BARON PHILIPPE DE ROTHSCHILD France DISTRIBUTION network;

  • staff members of companies participating directly or indirectly in the production of the Contest, and in particular, staff members of RPCA;

  • spouses and family members of the aforementioned persons.

Participation in the Contest constitutes full and automatic express and unreserved acceptance by the Participants, in particular, of these Rules, the rules of professional conduct in force on the Internet (code of conduct, etc.), as well as the laws and regulations in force in French territory, including the provisions applicable in France regarding games.

Consequently, failure to comply with these Rules, particularly the required conditions for participation, any falsified, fraudulent, false, misleading, incorrect, and/or inaccurate indications of identity or address, or violation of the other aforementioned provisions, will result in the invalidation of the entry.

ARTICLE III :

The Contest begins on Friday, May 19, 2017 upon the publication of the article at 8:00 PM and ends on Saturday, May 27, 2017 at 11:59 PM (Paris time).

To participate in the Contest, Participants must:

  • Visit the Mademoiselle Bon Plan blog and post a comment below the article mentioning this contest, answering the question asked in the article.

  • Read these Rules.

  • A prize draw will be carried out by the Mademoiselle Bon Plan blog, which will designate 1 winner (hereinafter referred to as the “Winner”) from among all the Participants.

ARTICLE IV :

The prize (hereinafter referred to as the “Prize”) up for grabs is:

A one-day pass for the We Love Green Festival, on Saturday, June 10, 2017, as well as temporary access to the Festival VIP area with a Green Cadet cocktail provided by Mouton Cadet, with a unit value of 49 euros.

This prize cannot be awarded in any other form than that provided for in these Rules and may not give rise to any dispute of any kind by the Winner, in particular, aimed at obtaining its cash equivalent, modification, replacement, or exchange for any reason whatsoever.

The Organizing Company reserves the right, however, to replace the Prize with another prize of equivalent or greater value in the event of circumstances beyond its control that would make the delivery of the prize impossible, without this substitution engaging the liability of the Organizing Company.

The Mademoiselle Bon Plan blog will designate the Winner on Sunday, May 28, 2017.

The Winner will be contacted directly by the Organizing Company at the contact details provided in the contest form.

If the Winner cannot be contacted during the day of Sunday, May 28, 2017, they will be considered as having waived their prize, and the prize will remain the property of the Organizing Company.

Article V :

Legality of the content disseminated

The Participant is responsible for the content they submit; they are required to respect the legal and regulatory provisions in force, particularly those that punish abuses of freedom of expression and that ensure respect for the image, dignity, and private life of human beings.

They must ensure that comments posted on MADEMOISELLE BON PLAN do not describe or encourage, in particular:

  • behavior of a racist, xenophobic, anti-Semitic, homophobic, revisionist, pornographic, pedophilic, child-pornographic nature, etc.,

  • abusive or defamatory behavior, or behavior that infringes on privacy, and more generally on the personality rights of anyone,

  • behavior infringing on human dignity,

  • behavior inciting violence, suicide, terrorism, the use, manufacture, or distribution of illicit substances,

  • behavior inciting the commission of crimes or offenses, or condoning them, and more particularly crimes against humanity,

  • behavior violating the intellectual property rights of third parties (notably articles, books), for which they do not have the necessary authorizations from the authors and/or rights holders,

  • behavior promoting for-profit services,

  • behavior encouraging alcohol consumption among minors,

  • behavior generally encouraging excessive alcohol consumption among any audience.

This list is not exhaustive, and the Participant is informed that the Organizing Company reserves the right not to make public or to delete any comment describing or inciting behavior in violation of legal or regulatory provisions, or contrary to these Rules, but also to exclude from the Contest and to initiate legal proceedings against any Participant who is the author of such a comment.

INTELLECTUAL PROPERTY RIGHTS

The Organizing Company and its partners are the owners of all intellectual property rights related to the Contest. These rights belong to them, or they hold the rights of use and/or exploitation related thereto. Access to and participation in the Contest do not confer upon the Participant any right over these intellectual property rights.

ARTICLE VI :

The Organizing Company reserves the right to shorten, extend, modify, or cancel the Contest in the event of force majeure or if circumstances beyond the control of the Organizing Company so require, without its liability being engaged as a result.

Participation via the Internet implies knowledge and acceptance of the characteristics and limitations of the Internet, particularly concerning the lack of protection of certain data against potential misappropriation or hacking, and risks of contamination by any viruses circulating on the network, technical performance, response times to consult, query, or transfer information, risks of interruption, and more generally, the risks inherent to any connection and transmission on the Internet.

It is the responsibility of every Participant to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any infringement. Any person connecting to the site or application and participating in the Contest does so at their own risk.

Furthermore, the liability of BARON PHILIPPE DE ROTHSCHILD France DISTRIBUTION cannot be engaged in the event of misuse or an incident related to the use of the computer, any malfunction of the Internet network, the Contest servers, the telephone line, or any other technical connection preventing the smooth running of the Contest. In the event of a technical malfunction of the Contest, the Organizing Company reserves the right, if applicable, to invalidate and/or cancel the Contest session during which said malfunction occurred. No claims will be accepted on this basis.

The Organizing Company cannot be held responsible if the data related to the registration of a Participant does not reach it for any reason for which it cannot be held responsible (for example, an Internet connection problem due to any reason on the user’s end, a temporary failure of the servers for any reason, etc.) or reaches it illegible or impossible to process (for example, if the participant has inadequate computer equipment or software environment for their registration, etc.).

Consequently, the Organizing Company cannot under any circumstances be held liable, without this list being exhaustive:

  • For the transmission and/or reception of any data and/or information on the Internet;

  • For any malfunction of the Internet network preventing the smooth running/operation of the Contest;

  • For any failure of any receiving equipment or communication lines;

  • For the loss of any paper or electronic mail and, more generally, for the loss of any data;

  • For routing problems;

  • For the operation of any software;

  • For the consequences of any viruses, computer bugs, anomalies, or any technical or hardware failure that has prevented or limited the possibility of participating in the Contest.

More generally, the liability of the Organizing Company cannot be engaged in the event of force majeure or fortuitous events beyond its control. It cannot be held responsible either, and no recourse can be taken against it in the event of the occurrence of events having the characteristics of force majeure (strikes, bad weather, etc.) depriving Participants partially or totally of the possibility of participating in the Contest and/or the Winner of the benefit of their prize. Similarly, neither the Organizing Company nor its service providers can be held responsible for any incidents occurring during the use of the prize after it has been delivered to the Winner.

  • ARTICLE VII :

  • The Organizing Company may cancel all or part of the Contest if it appears that fraud has occurred in any form whatsoever, particularly in a computer-related manner, in the context of participation in the Contest.

  • It reserves the right, in this case, not to award the Prize to the fraudsters, to recover the Prize in the event of the discovery of fraud after its award, and/or to prosecute before the competent courts the authors and/or accomplices of these frauds.

  • Any difficulty in interpreting or applying these Rules will be decided by the Organizing Company.

ARTICLE IX :

The personal data of the Participants collected in the context of this Contest is mandatory for the registration of their participation in the Contest and its follow-up. It is subject to processing implemented by the Organizing Company, declared to the CNIL and having purposes in compliance with those dictated by the CNIL (deliberation n°2012-209 of 06/21/2012). The recipients of the data may be companies of the BARON PHILIPPE DE ROTHSCHILD France DISTRIBUTION distribution network in France, companies of the BARON PHILIPPE DE ROTHSCHILD group, as well as commercial partners. This data may be used for commercial solicitation purposes with the prior consent of the Participants.

In accordance with the “Data Protection Act” (Informatique et Libertés) of January 6, 1978, amended in 2004, you have a right of access, rectification, and deletion of your data as well as the right to object to the processing of this data.

Any request must be accompanied by a double-sided copy of an official identity document.

ARTICLE X :

Any difficulty in interpreting or applying these Rules will be decided by the Organizing Company in compliance with French legislation. Any behavior by a Participant that could harm the image of the Organizing Company and/or be contrary to public order and/or morality may lead to the invalidation of the participation in the Contest of said Participant. The Organizing Company may, automatically and without notice, exclude any Participant who has not complied with these Rules, and proceed to the outright cancellation of any Prize to which said Participant could claim.

In the event that any of the clauses of these Rules becomes null and void due to a change in legislation, deregulation, or a court decision, this shall in no way affect the validity and compliance with the other clauses of these Rules.

ARTICLE XI :

The Contest and these Rules are subject exclusively to French law.

The courts of the jurisdiction of Bobigny shall have sole jurisdiction to deal with the occurrence of any dispute relating to the validity, application, or interpretation of these Rules.
